These Terms of Service ("Terms") govern your use of our website, www.coldbeer.co.nz (the "Site"), and the services provided by COLDBEER LTD.
By accessing or using our Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site.
**1. Use of the Site**
1.1 You must be at least 18 years old to use our Site and order beer. By using our Site, you represent and warrant that you are at least18 years old.
1.2 You agree to use the Site for lawful purposes only. You are responsible for ensuring that your use of the Site complies with all applicable laws and regulations. Specifically, you agree that you are not purchasing alcohol for minors or for any other illegal purposes.
**2. Account Registration**
2.1 To place an order, you may be required to create an account. You agree to provide accurate and complete information during the registration process and to keep your account information up to date.
2.2 You are responsible for maintaining the confidentiality of your account information and password. You agree to notify us immediately of any unauthorized use of your account.
**3. Ordering and Payment**
3.1 By placing an order on our Site, you agree to pay for the beer and delivery services in advance.
3.2 All prices are listed in New Zealand Dollars (NZD) and include applicable taxes.
3.3 We accept online payment methods as indicated on our Site. You agree to provide valid payment information and authorize us to charge your selected payment method for the total amount of your order.
3.4 We strive to ensure that all beers listed on our website are available locally at the time of your order. However, if we are unable to locate the specific beer you ordered within a reasonable time frame, we will promptly contact you using the email address or mobile number provided during registration . In such cases, we will inform you of the unavailability and process a full refund within three (3) working days.
3.5 If we are unable to supply beer in a 24-pack box as ordered, we may substitute it with two 12-pack boxes to ensure timely delivery.
3.6 If COLDBEER is unable to find the quantity or type of beer that has been ordered, it reserves the right to refund the customer's money within five (5) banking days.
**4. Delivery**
4.1 We supply beer from local supermarkets / liquor shops and deliver it to the address specified in delivery address during checkout (Delivery Only in New Plymouth NZ).
4.2 Delivery times may vary based on your location and product availability, yet we do our best to fulfil your order within 45 to 90 minutes post payment. 4.3 You must be present to receive the delivery and may be required to provide proof of age. We reserve the right to refuse delivery if you are unable to provide proof of age.
4.4 Orders will be fulfilled with either cans or bottles of the selected beer, depending on availability in the local market.
**5. Returns and Refunds**
5.1 We do not accept returns of alcoholic beverages unless the product is defective or damaged upon delivery.
5.2 If you receive a defective or damaged product, please contact us within 24 hours of delivery to arrange for a replacement or refund.
**6. Limitation of Liability**
6.1 To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site or the services provided.
6.2 Our total liability to you for any claim arising out of or in connection with these Terms or your use of the Site shall not exceed the amount you paid for the order in question.
**7. Governing Law**
These Terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.
**8. Changes to the Terms**
We may update these Terms from time to time. The updated Terms will be posted on our Site, and your continued use of the Site after such changes will constitute your acceptance of the updated Terms.
